Copyright Guidelines of the IPSJ

The Information Processing Society of Japan (IPSJ) is committed to provide services, such as the printing, distribution or web transmission of research papers, etc., which are responsive to the expectation of article contributors, other IPSJ members and the society, while maintaining quality consistent with the fame and prestige of the IPSJ. Furthermore, the IPSJ must be able to provide these services safely and continuously, while responding flexibly to new technologies foreseen in the future as well as to changes in the needs of members and the society.

For these purposes, it is necessary to make clear the handling of copyright concerning materials to be made public by the IPSJ under its own name. Under the Guidelines, copyright for these materials will be required, in principle, to be assigned to the IPSJ, but consideration will be made such that the resulting inconvenience to the authors may be as little as possible.

(Purpose of the Guidelines)

Article 1 The Guidelines provide for the handling of copyright of authors and contributors (hereinafter collectively called "Authors") for papers, etc. submitted to the IPSJ (including papers, review articles, etc. contributed to IPSJ publications as well as research reports, draft manuscripts, etc. for symposia and national conferences, etc. submitted to the IPSJ, hereinafter collectively called "Papers").

(Copyright Ownership)

Article 2 All copyrights whether inside or outside Japan (hereinafter including all rights* provided for in Articles 21 through 28 of the Copyright Law of Japan) for Papers submitted to the IPSJ shall in principle belong to the IPSJ as from the time when the final manuscript is submitted to the IPSJ.

2. Where the principle set forth in the preceding section cannot be applied because of special circumstances, the Author shall, at the time of the submission, so inform in writing the IPSJ office responsible for receiving submissions. In such an event, the handling of copyright will be determined based on consultation between the Author and the IPSJ.

3. Where a decision is made not to publish in IPSJ publications particular Papers submitted to the IPSJ, the IPSJ will return the copyright for such Papers to the Author.

(No Exercise Covenant) 

Article 3 In any of the following cases, the Authors shall not exercise their moral rights against the IPSJ and those persons licensed by the IPSJ:

(1) Translations and associated modifications

(2) Modifications associated with electronic transmission

(3) Use by way of preparing abstracts only

(4) The other modifications which are not appropriate to apply the right of preserving the integrity in any cases that such modification is made in accordance with laws and regulations

(Grant of Licenses to Third Parties) 

Article 4 Where a request is made by a third party for the grant of a license under copyright, the IPSJ will deliberate on the request at its Board Meeting and may comply with the request if deemed appropriate. Furthermore, upon approval of a Board Meeting, the IPSJ may entrust to an outside body the administration of the rights to be licensed.

2. Where consideration is paid by a third party to the IPSJ as the result of the steps taken pursuant to the preceding section, such consideration will be reflected in the account of the IPSJ and will be effectively utilized for the purpose of IPSJ activities.

(Rights of Authors)

Article 5 The IPSJ will not raise objections to, or take steps to prevent, the use, in accordance with the Guidelines, by the Authors themselves of their materials, such as Papers, for which the copyright is owned by the IPSJ.

2. Where Authors desire to use their materials, the Authors shall inform the IPSJ in advance, comply with IPSJ instructions, and specify, in copies or materials used, those IPSJ publications which are the sources. However, the foregoing will not apply if the original Papers are modified 25% or more. Furthermore, the Authors need not inform the IPSJ in case of uses provided for in section 3 or 5 below.

3. Of Papers, the Authors may not submit to other academic societies those Papers for which the final manuscripts were received by the IPSJ based on a decision, that had been made as the result of review by the IPSJ, to include the same in publications consisting primarily of papers (hereinafter including journals and transactions) as well as articles in IPSJ bulletins. Furthermore, of Papers, research reports, draft manuscripts for symposia and draft manuscripts for national conferences (hereinafter called "Research Reports") will be deemed to be interim research results and the IPSJ will not raise objections, for the reason that the IPSJ owns the copyright, to the Authors and other academic societies, etc. with respect to the submission, by the Authors, of such Research Reports to such other academic societies, etc. in order to render such Research Reports to be the final research results (hereinafter called "Paperizing Submission").

4. Where, in conjunction with Paperizing Submission, the Authors make a request to the IPSJ for the return of the copyright and the IPSJ deems the request to be based on a just reason, the IPSJ will return the copyright for the Research Reports in question to the Authors. However, the Authors shall grant to the IPSJ a license under the copyright for such Research Reports such that the IPSJ may continue, in regard to such Research Reports, those activities that are necessary for IPSJ operations (for example, the granting of a reproduction right to third parties and the publishing of the Research Reports by way of web sites, CD-ROMs, etc. prepared by the IPSJ). With respect to such grant of a license, the Authors shall inform in advance the other academic societies, etc. to which the submission is made, and if a dispute arises vis-a-vis such academic societies, etc. on account of the granting of such license to the IPSJ, the IPSJ will attempt to resolve the dispute in cooperation with the Authors.

5. The Authors may publish materials of their own creation on their personal web sites (hereinafter including web sites of those organizations to which the Authors belong) irrespective of whether before or after the publication by the IPSJ of the Papers submitted to the IPSJ. However, the Authors shall comply with the "Code of Ethics of the Information Processing Society of Japan" in conjunction with such publication and shall specify IPSJ publications which are the source (if already published) as well as the notice for the use** .

(Exceptions) 

Article 6 Where there is a special arrangement with respect to copyright for Papers to be submitted to events co-sponsored with other academic societies, etc., notwithstanding the preceding Articles, such arrangement will take precedence over the Guidelines.

(Copyright Infringement and Dispute Resolution)

Article 7 Where there is an infringement (or a suspected infringement) of copyright owned by the IPSJ for Papers, the IPSJ and the Authors will consult with each other on measure to be taken and will attempt to resolve the same.]

2. Where Papers submitted to the IPSJ give rise to a problem of infringement of copyright or other right and interest of a third party, the Authors of the Papers in question shall have the entire responsibility.

(Sample Codes)

Article 8 Programs, configuration files, input data etc. (hereinafter collectively called "Sample Codes") inserted in Papers, for which the copyright belongs to the IPSJ, except where there is a special arrangement with respect to copyright for Papers or publications consisting primarily of the papers, notwithstanding that they may be for profit or not, the users of Sample Codes have the right to copy, translate, and modify all or any portion of Sample Codes including adaption etc, and to exhibit them publicly, transmit them publicly, or assign them to the public by transfer of ownership of the original or copies.

(Disclaimer)

Article 9 Papers (including Sample Codes; hereinafter the same shall apply in this article) are provided "as is" and the IPSJ gives no guarantee, either expressed or implied, with regard to the accuracy, merchantability, completeness or fitness for a particular purpose of Papers, regardless of whether the Papers are reviewed by applying the IPSJ review process. The IPSJ disclaims any damage, including that caused by infringement of intellectual property, as a consequence of applying the information presented in Papers, regardless of whether the damage is to be anticipated in normal circumstances or caused by special circumstances.

(Effective Date) 

Article 10 The Guidelines will become retroactively effective as of April 1, 2000. The Guidelines will also apply to copyright for Papers submitted prior to April 1, 2000 unless the Authors make a request for a different handling and the IPSJ deems such request to be based on a just reason.
